1. Introduction and Acceptance of Terms

Welcome to KnowledgeBass (the "Service," "App," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the website located at knowledgebass.com and all associated services, features, and content (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice, such as by posting an updated version on the Service or notifying you via the email address associated with your account. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

2. Beta Status and Service Availability

KnowledgeBass is currently offered as a beta product. By using the Service, you acknowledge and agree that:

  • The Service is under active development and is provided for evaluation and testing purposes, in addition to general use.
  • The Service may contain bugs, errors, glitches, inaccuracies, or other issues that could affect functionality, performance, security, or data integrity.
  • Features, functionality, and the availability of the Service may change, be added, be removed, or be discontinued at any time without notice.
  • Data, content, settings, or account information may be lost, corrupted, reset, or otherwise affected as a result of the Service's beta status.
  • We make no guarantee regarding uptime, reliability, or continuity of the Service during the beta period.

We encourage users to report bugs or issues they encounter. Feedback you provide regarding the Service may be used by us to improve the Service without any obligation or compensation to you, except as otherwise agreed in writing.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 13 years old to use the Service. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

3.2 Account Creation

To access certain features of the Service, you must create an account. Account registration requires a valid, verified email address. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Complete the email verification process before accessing account-dependent features;
  • Maintain and promptly update your account information as needed;
  • Maintain the confidentiality and security of your account credentials;
  • Notify us immediately of any unauthorized access to or use of your account.

You are solely responsible for all activity that occurs under your account, whether or not authorized by you, except to the extent caused by our breach of these Terms.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion, including for violation of these Terms, suspected fraudulent or abusive activity, or extended inactivity. You may also delete your account at any time through the Service or by contacting us.

4. Apple Music Integration via MusicKit

4.1 Overview

The Service uses Apple's MusicKit on the Web to provide music-related features. If you choose to connect your Apple Music account, you authorize the Service to interact with Apple Music on your behalf, subject to the permissions you grant.

4.2 Authorization and Apple's Terms

By connecting your Apple Music account, you acknowledge that:

  • You must have a valid Apple ID and, for full functionality, an active Apple Music subscription;
  • Your use of Apple Music through the Service is also governed by Apple's own terms, including the Apple Media Services Terms and Conditions and Apple's Privacy Policy, which you are responsible for reviewing and accepting separately;
  • We do not control, and are not responsible for, Apple's services, policies, pricing, availability, or content catalog;
  • Playback, metadata, and catalog availability are provided by Apple and may vary by region, subscription status, or changes made by Apple at any time;
  • You may revoke the Service's access to your Apple Music account at any time through your Apple ID account settings or within the Service, where available.

4.3 No Affiliation

KnowledgeBass is not affiliated with, sponsored by, or endorsed by Apple Inc. Apple, Apple Music, and MusicKit are trademarks of Apple Inc., registered in the U.S. and other countries.

4.4 Limitations

We are not responsible for any interruption, limitation, or termination of Apple Music functionality resulting from changes to Apple's MusicKit platform, your Apple Music subscription status, or actions taken by Apple.

5. Third-Party Embedded Content

The Service may display or embed content hosted by third-party platforms, including but not limited to YouTube and X.com ("Third-Party Content"). This may include embedded videos, posts, clips, or other media.

You acknowledge and agree that:

  • Third-Party Content is owned and controlled by its respective rights holders and platforms, and is subject to those platforms' own terms of service, community guidelines, and privacy policies (e.g., YouTube's Terms of Service and X's Terms of Service);
  • We do not host, control, endorse, verify, or assume responsibility for the accuracy, legality, or appropriateness of Third-Party Content;
  • Viewing embedded content may involve the third-party platform collecting data about your device or usage, in accordance with that platform's own privacy practices, independent of our Privacy Policy;
  • Third-Party Content may become unavailable, be modified, or be removed at any time due to actions taken by the third-party platform or the original content owner, and we are not responsible for any such changes;
  • Embedding of content is done in a manner intended to comply with each platform's applicable embedding policies and is not intended to infringe any copyright or other rights. If you believe Third-Party Content displayed on the Service infringes your rights, please contact us using the information in Section 16.

6. User Conduct

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party right;
  • Upload, transmit, or share content that is unlawful, defamatory, obscene, harassing, or infringing;
  • Attempt to gain unauthorized access to the Service, other users' accounts, or related systems or networks;
  • Interfere with, disrupt, or impose an unreasonable burden on the Service or its infrastructure;
  • Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent;
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service, except where permitted by law;
  • Circumvent or attempt to circumvent any authorization, security, or rate-limiting measures, including those related to Apple Music or other third-party integrations;
  • Use the Service to infringe upon the intellectual property rights of Apple, YouTube, X, or any other third party.

We reserve the right to investigate and take appropriate action against anyone who violates this section, including removing content, suspending or terminating accounts, and reporting violations to law enforcement.

7. Intellectual Property

7.1 Our Content

The Service, including its design, text, graphics, logos, and underlying software (excluding Third-Party Content and content provided via Apple Music), is owned by KnowledgeBass or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

7.2 Third-Party Trademarks and Content

All trademarks, service marks, music, video, and other content provided through Apple Music, YouTube, X, or other integrated third-party services remain the property of their respective owners. Nothing in these Terms grants you any rights to such third-party content beyond what is provided by the applicable third party's own terms.

7.3 User Content

If the Service allows you to submit, upload, or create content ("User Content"), you retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content as necessary to operate and provide the Service to you.

8. Privacy

Our collection and use of your personal information, including information related to your account, email address, and any data obtained through Apple MusicKit integration, is described in our Privacy Policy. By using the Service, you consent to the collection and use of your information as described there.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

GIVEN THE SERVICE'S CURRENT BETA STATUS, WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF BUGS OR DEFECTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR AVAILABILITY OF ANY THIRD-PARTY CONTENT, APPLE MUSIC INTEGRATION, OR EMBEDDED MEDIA FROM YOUTUBE, X, OR OTHER PLATFORMS.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KnowledgeBass, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE;
  • ANY BUGS, ERRORS, OR INTERRUPTIONS ARISING FROM THE SERVICE'S BETA STATUS;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR THROUGH THE SERVICE, INCLUDING THIRD-PARTY CONTENT FROM YOUTUBE OR X, OR ANY ISSUES ARISING FROM YOUR APPLE MUSIC INTEGRATION;
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless KnowledgeBass and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including rights related to Apple Music, YouTube, or X content; or (d) any content you submit through the Service.

12. Third-Party Services Generally

The Service relies on and integrates with third-party platforms, including Apple's MusicKit, YouTube, and X. We do not control these platforms and are not responsible for their availability, content, policies, or any changes they make that affect the Service. Your use of these third-party platforms, whether directly or through the Service, is at your own risk and subject to each platform's own terms and policies.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service, or any part of it, at any time, with or without notice. This includes the right to remove or modify features related to Apple Music integration or embedded third-party content if required by changes to those platforms' policies, technical requirements, or licensing terms. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of California, without regard to its conflict of laws principles.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, network or infrastructure failures, or actions taken by third-party platforms such as Apple, YouTube, or X.
